1. Acceptance of Terms

By accessing or using the SumoTrends platform ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you must not access or use the Service.

2. Eligibility

You must be at least 18 years of age to use this Service. By using the Service, you represent and warrant that:

• You are at least 18 years old
• You have the legal capacity to enter into a binding agreement
• You are not barred from using the Service under applicable law

3. License and Use of Data

Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, non-sublicensable license to access and use the Service for your internal business purposes.

3.1 Prohibited Uses

You explicitly agree NOT to:

• Resell, redistribute, or sub-license the raw data found on SumoTrends to third parties.
• Publicly publish substantial portions of our database (e.g., posting a CSV export on a public forum).
• Share your login credentials with others outside your organization. We monitor concurrent logins and IP usage.
• Use automated scripts (scraping) to extract data from our Service.

3.2 Violation

Any violation of this section will result in immediate termination of your account without refund and may lead to legal action for intellectual property infringement.

4. Refund Policy

4.1 Eligibility for Refund

We offer a 30-Day Action-Based Money-Back Guarantee. To qualify for a refund, you must demonstrate that you have used the Service but failed to find viable market opportunities. You must submit a refund request within 30 days of purchase with the following "Proof of Action":

1. Search History: Provide screenshots showing at least 3 specific niches, categories, or keywords you searched for within the platform.
2. Opportunity Analysis: Provide a brief summary (2-3 sentences) of 3 specific products you analyzed from the database, explaining why they were not viable opportunities for your situation.
3. Feedback: One specific suggestion on how we could improve the data or platform for your use case.

5. Earnings & Data Disclaimer

SumoTrends is a market research tool. We provide data based on historical performance of third-party products.

• No Income Guarantee: We do not guarantee that you will make money, obtain traffic, or build a successful business using our data.
• Business Risk: Your business results are dependent on your own execution, market conditions, and skills. You assume all risks associated with your business decisions.
• Data Estimates: Revenue figures, market volume, and other financial data displayed on our platform are estimates based on publicly available information (review counts, pricing tiers, and historical patterns). These are not verified actual revenues and should be used for directional guidance only.

6. Intellectual Property

The design, structure, algorithms (including "The Profitability Algorithm™"), and compilation of data on the Service are the proprietary property of SumoTrends. You own the insights and business ideas you derive from the data, but you do not own the database structure itself.

7. Limitation of Liability

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED.

To the maximum extent permitted by law, SumoTrends shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from your access to or use of or inability to access or use the Service.

8. Account Termination

We reserve the right to suspend or terminate your account immediately, without prior notice or liability, if you breach these Terms, specifically Section 3 (License and Use of Data).

9. Dispute Resolution

Informal Resolution: Before filing a claim, you agree to try to resolve the dispute informally by contacting us atlegal@sumotrends.com. We will attempt to resolve the dispute within 30 days.

Binding Arbitration: If informal resolution fails, any disputes arising from these Terms shall be resolved through binding arbitration administered by the American Arbitration Association (AAA) in accordance with its Commercial Arbitration Rules.

Class Action Waiver: You agree that any dispute resolution proceedings will be conducted only on an individual basis and not in a class, consolidated, or representative action.

10. Modifications to Terms

We reserve the right to modify these Terms at any time. If we make material changes, we will notify you via email or through a prominent notice on our platform at least 30 days before the changes take effect. Your continued use of the Service after the effective date constitutes acceptance of the modified Terms.

11. Governing Law

These Terms shall be governed and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of law provisions.
